Residence options in Germany

Moving to Germany is an exciting adventure. Germany is a place full of different people and the possibilities are endless. There are beautiful cities and beautiful nature. You won't regret moving there for a second. The downside, however, is until you have settled in, there are some hurdles to overcome. Germany is known as a country with a lot of bureaucracy. There are several processes to go through in order to be able to stay in Germany.

If your sole purpose is to visit Germany for tourism purposes, you do not need to worry about a residence permit. A tourist visa allows you to stay in Germany for approximately 90 days to explore the country. A stay beyond the permitted 90 days is not possible without a residence permit.

With a German residence permit, you can stay in Germany for longer than 90 days. With the exception of people from EU countries, Switzerland, Norway, Iceland and Liechtenstein, all other foreigners require a residence permit to stay in Germany for longer than 90 days.

Many foreign nationals must apply for a residence permit for Germany from their home countries in order to obtain a Schengen visa to enter Germany for 90 days. For some countries, it is possible to enter Germany without a visa during these first 90 days and apply for the residence permit from within Germany.

Types of residence permit

There are different types of German residence permits depending on the length of stay and the requirements you have to fulfill. There are three types of residence permit that allow you to stay in Germany for different periods of time.

Temporary residence permit

The temporary residence permit, or residence permit, is for shorter stays in Germany. If you wish to obtain this type of residence permit, you may only stay in Germany for one year. There is the possibility of an extension, provided that your situation does not change and you meet the requirements.

Temporary residence permit

Foreigners receive a temporary residence permit if they wish to stay in Germany for a specific reason. For this type of permit, you have to justify why you want to stay in Germany. If you apply for a temporary residence permit to study, it is recorded that you are only studying and cannot work.

The temporary residence permit is the first type of permit that most foreigners receive. It creates the basis for permanent residence in Germany. One of the requirements for the permanent permit is to have held the temporary permit for a certain period of time. There are many reasons why a person would want to have a temporary residence permit for Germany:

  • for employment purposes
  • for admission to a course of study
  • for the marriage
The EU Blue Card

The EU Blue Card is similar to the temporary residence permit, but is aimed at a specific group of people and has a longer validity. The EU Blue Card is intended for foreign nationals from non-EU countries who have a high level of professional education and wish to work in Germany. Highly qualified employees have a university degree such as a Bachelor's or Master's degree. Those who are more likely to receive the EU Blue Card have an IT or STEM background (science, technology, engineering, mathematics).

To qualify for the EU Blue Card, they must find a job in Germany that allows them to practice the skills they acquired during their studies. The job must match their educational qualifications. In addition, they should be able to earn at least 50,800 euros per year and have a high level of German language skills.

The EU Blue Card is valid for four years and those who hold it can get permanent residence immediately if they keep their job. They qualify for permanent residence after 33 months, but if they speak German well, they can get it after 21 months.

If you have an EU Blue Card, you can also bring your spouse with you to Germany. The spouse does not necessarily have to be able to speak German well and can work after you have obtained permanent residence.

Unrestricted residence permit

In order to be allowed to stay in Germany for as long as possible, you need a German permanent residence permit. This is also known as a settlement permit or, in German, Niederlassungserlaubnis. With a permanent residence permit, you can work in Germany and travel abroad whenever you want.

This permit is usually issued to people who have held a temporary residence permit for several years or are holders of an EU Blue Card. You must prove that you have worked for at least 5 years, that the work has been approved by the Federal Employment Agency and that you have paid the necessary taxes and duties to the government. In addition, the requirements for German language skills are stricter, so advanced German is required.

If you have a permanent residence permit, your children and spouse may join you. You will initially receive a temporary residence permit and can obtain a permanent residence permit after a few years.

German residence permit - The requirements

A number of requirements must be met in order to obtain one of the residence permits:

  • Valid passport from another country
  • have no criminal record
  • German language skills of at least level B1 according to the Common European Framework of Reference for Languages
  • be in possession of German health insurance
  • passing a health check that shows you are healthy enough to work and/or study
  • Financial stability should be ensured
  • if you want to work in Germany, you need a letter from an employer
  • you receive a letter from an employer with
  • if you are studying in Germany, you need proof that you have been admitted to a university
  • if you want to live with your spouse in Germany, you need proof of marriage, for example a marriage certificate
The Skilled Immigration Act

also: Act on the Further Development of Skilled Immigration) simplifies immigration from third countries.

The Skilled Immigration Act in Germany, which came into force on March 1, 2020, aims to make it easier for qualified skilled workers from non-EU countries to immigrate to Germany in order to counteract the shortage of skilled workers in certain professional fields. The law represents an important change in German migration policy and opens up new ways for qualified workers to take up employment in Germany. Here are some of the key points of the law:

Easier access for qualified specialists

  • Qualifications: Persons with a recognized university qualification or qualified vocational training have the opportunity to enter Germany to take up employment.
  • Recognition of qualifications: The law simplifies the procedure for recognizing foreign professional qualifications.

Visa for job search

  • Qualified skilled workers can obtain a visa to look for a job in Germany, which is valid for up to six months, provided they can finance their own living expenses during this time.

  • IT specialists without formal qualifications, but with proven professional experience and specialist knowledge, can also enter the country under certain conditions.

Accelerated procedure for skilled workers

  • For certain professional groups and with the involvement of the employer, accelerated procedures for issuing visas ("fast-track procedure") can be used.
